Terms of Service

Engage is operated by Nyasha Mandizvidza under the Zimplugs brand in Zimbabwe.

By creating an account, accessing, or using the Engage platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of a company, you represent that you have authority to bind that entity.

If you do not agree to these Terms, do not use the Service.

To use the Service you must register for an account by providing accurate and complete information, including a valid business email and verified WhatsApp number where applicable.

• You are responsible for safeguarding your account credentials and for all activity under your account.
• You must notify us immediately at security@engage.zimplugs.com of any unauthorised access.
• You must be at least 18 years old to create an account.

Paid plans are billed in advance on a recurring monthly or annual basis. Pay-as-you-go message credits are deducted from your wallet as you ship.

Billing cycle

Subscription fees auto-renew at the end of each billing period unless cancelled before the renewal date. You can cancel anytime from your account settings.

Taxes

All fees are exclusive of applicable taxes (GST, VAT, sales tax). Taxes are added at checkout based on your billing address.

You agree to use the Service in compliance with applicable data-protection and anti-spam laws and Meta's WhatsApp Business Policy.

Engage is a multi-tenant SaaS service. You receive a non-exclusive, non-transferable, revocable licence to use the Service under your plan.

You may not use Engage to send spam, phishing messages, malware, illegal content, or messages without proper opt-in consent. Detailed restrictions are listed in our Acceptable Use Policy.

Violations may result in immediate suspension of your account without refund.

You retain your rights to customer data uploaded to the Service. Personal data is described in the Privacy Policy.

Operating Engage from Zimbabwe does not mean all data is hosted in Zimbabwe. Ask the operator for details of the hosting, service providers and safeguards relevant to your use before providing data subject to particular residency or contractual requirements.

Use of the Service does not transfer ownership of software, designs, trademarks, documentation or other intellectual property. Third-party software and assets remain subject to their respective licences.

You retain ownership of your content, templates, flows and customer data.

Each party agrees to keep the other's confidential information confidential and to use it only for purposes of the Service. This obligation survives termination for 3 years.

The Service is provided "as is", subject to rights that cannot be excluded under applicable law. We do not guarantee uninterrupted operation or that the Service will meet your specific requirements.

To the maximum extent permitted by law, Engage's aggregate liability under these Terms is capped at the fees you paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or data.

You agree to indemnify and hold Engage harmless from any claims, damages, or expenses arising from your violation of these Terms, your use of the Service, or your customer data.

We may suspend or terminate access for breach of these Terms, the Acceptable Use Policy, or non-payment.

Account deletion and data-deletion requests are described in the Privacy Policy. Deleting a login does not establish that all workspace, message, billing or backup records have been erased. Request confirmation of the outcome and any retention exceptions through support.

We may update these Terms from time to time. Material changes will be notified by email at least 30 days before they take effect. Continued use of the Service constitutes acceptance.
